The truth comes out more easily from the mouths of children than of adults
It's not a war of numbers but rather the future of thousands of children that Justice refuses to believe and trust in its custody to the abusive parent considered falsely accused, through parental separation. This injustice must stop.
Our associations are responsible for hundreds of files of this type, presented by desperate mothers unable to protect or defend their children against abuse, because Justice refuses to believe them. A story told in the play "The truth shall set you free," which illustrates how the famous "Parental Alienation Syndrome" is returned and used to discredit the victim's right. These judicial dysfunction, presented in part, have been denounced by the UN which condemned France in 2002, but since then nothing has been done by the French state to change that.
The truth comes out more easily from the mouths of children than of adults, an article by Claudia Jankech
Switzerland signed the Convention on the Rights of the child making these people to meet while taking into account their specific needs because of their growing status of subjects who adults must assist and protect. This recognition leads to a new social contract, that some adults are reluctant to accept, either because they confuse the positive authority necessary for the upbringing of the child with the power to dispose of the child, either through lack of serious concerning children, or simply for fear of losing their superior status. Among the signs of sexual abuse that power are the most despicable.
Current research on sexual abuse highlight the devastating effects of abuse *: (American Associaton Psychiatrist, Document Reference No. 930003, Memories of Sexual Abuse) "Sexual abuse of children and adolescents causes severe negative consequences. Sexual abuse of children is a risk factor for several mental disorders, including anxiety disorders, affective disorders, dissociative disorders and personality disorders "
The Medical Tribune 13 March 2009, publishes the results of a Canadian study conducted by Patrick Mc Gowan (Douglas Mental Health University Institute in Montreal), who works on the mechanisms that may cause such severe mental disorders: "Sexual abuse and abuse during early childhood can alter the response to long-term stress by inducing epigenetic changes. This study "provides the first evidence in humans (... ..), the childhood trauma are associated with altered stress response and an increased risk of psychiatric disorders."
Professor Danya Glaser (Congress Ism, Pescara 2006) has reported research showing that stress increases cortisol, the hormone attacks the myelin that surrounds nerve fibers and explain the many deficits that experts found among children whose myelination is courses that are under stress related to abuse.
These scientific findings should prompt us to make every effort to provide assistance to child abuse and mistreatment which also involves the detection of possible false allegations. But some, pointing out the inevitable false testimony resounding (Outreau case), coming even children, would throw suspicion on the floor of the child as if it were more susceptible than adults to lie as easily influenced.
As if the child was the one being manipulated. The media, for example, do not fail to cite cases of children who falsely accused their father or any other person, by hiding the highlighting of isolated facts, the large number of cases of children who defy their fears for reveal the traumatizing abuse.
interventions of experts in the media does not always contribute to clarify the situation. For example, Professor Jaffe saying: "When ... separations painful, 90% of sexual abuse accusations are unfair. This is a known syndrome, that of parental alienation. It is brainwashing of the child by the parent - sometimes in good faith - who wants revenge for her husband. And it skews everything. (Interview 24hs of 12/25/2005)
It turns out that serious research, conducted on very large cohorts (135,573 surveys analyzed by Trocmé et al., 2001, Canada) to give children the following figures:
"... fathers who do not care reported 43% of all cases of intentionally false allegations documented in the CIS-1998, while mothers with custody of children are responsible for 14% of false allegations. It is important to know that even in the context of parental separation, most of the unfounded allegations were reported in good faith. In these cases, genuine misunderstanding or a lack of communication are at the basis of unfounded allegation. Moreover, even in cases of parental separation, 40% of reports are substantiated and 14% remained suspected.
Regarding children, they are responsible for only 2% of intentionally false allegations. Thus the figure
46% would rather be in litigation for custody and not 90%, and they are rarely made by the child but rather by his entourage.
Other research, also from Canada (Allegations of Sexual Abuse When Parents Have Separated, Nicholas Bala and John Schuman. Professor Nicholas Bala, Faculty of Law, Queen's University, Kingston, Ontario, May 1999) show that *: "Several allegations of sexual abuse made by children after parental separation are true. In some situations, the abuse began when the family is still united, but the child feels too intimidated by the presence of the abuser disclose abuse before the separation. Where there has been abuse of the spouse, parent without abusing may feel unable to take steps to protect the child before separation. In several cases, particularly in cases of sexual abuse, the abuse does not begin until the separation is due to loneliness and emotional needs of the parent who begins to abuse the child. Thus, some parents abusers, who are sexually attracted to children are pedophiles (that is, they have a sexual attraction towards children) - in many cases the abuse is more situational than se pedophile. In some cases, the abuse may be perpetrated by the new partner of the parent and begins only after the latter has to reside with the parent. "
Research Findings: "Each case must be studied individually, with its merits, and not based on statistics on cases in general. (....) Anyway, cases involving allegations of sexual abuse are more difficult to resolve through mediation and negotiation are more frequent and finishing trial.
It appears from the literature that the allegations of sexual abuse are made in less than 10% of cases of proceedings for custody, may be it is less than 1 or 2% of cases. Among the group of families in conflict to the court for custody involving allegations of sexual abuse, the proportion of cases unproven or unfounded is high, probably between 25 and 75%. However, even where allegations are deemed unfounded, the share of intentionally false allegations is low, ranging between 3 and 30%. " Most
unsubstantiated allegations are the product of poor understanding and communication. If there intentionally false allegation, it is often the part of the accusing parent, but in rare cases the child (usually old) who deliberately makes a false allegation "
The concept of perjury was brought to justice for adults, it remains the largest source of false allegations, including in litigation for custody of the child.
54% of allegations of abuse are therefore suspected or substantiated, clearly show that if we can not always believe what is said in this context, the phenomenon of abuse and it is still important essential not to discredit the word of the child as such so that abuses are reported as soon possible and the child is well protected and the effects are minimized to the extent possible.
In no case should replace statistical analysis of specific cases and research evidence must prevail, as in any situation presented to Justice.
At the time of limitations for acts of crimes against children between the force and that discouraging people from voting for this initiative insist that it must detect child abuse as soon as possible because time would erase the evidence and alter memories, it is essential not to discredit the word of the child, presenting as questionable because qu'aliénée, then it turns out that the word of the child is more likely to be true than adults. The popular proverb
The truth comes from the mouths of children, remains valid. At most we could say the truth comes out easily from the mouths of children than of adults.
